Terms of Service

Business service. Deadweight is offered for business use. The contracting service provider is identified in the applicable order confirmation, invoice, or signed order form. Its legal name, postal address, governing law, and any order-specific terms will be shown before a paid order is accepted.

The service

Deadweight connects to a Klaviyo workspace through OAuth and can:

  • create or update a named review segment using the published recipe;
  • measure aggregate billable, candidate, and protected profile counts;
  • model possible plan impact using public price anchors and optional user-supplied spend;
  • after separate payment, expanded OAuth consent, and typed approval, snapshot and suppress the approved static list;
  • poll Klaviyo's bulk-job result, verify the later billable count, and submit a rollback during the available window;
  • schedule non-suppressing re-audits when Monitor is active.

Important boundaries

  • The free audit may write or update a review segment. It cannot bulk suppress profiles.
  • Deadweight never treats a savings estimate as a guaranteed invoice result.
  • Suppression processing, billable-count updates, auto-downgrade availability, plan changes, taxes, add-ons, and contracted pricing are controlled by Klaviyo and your account terms.
  • Rollback does not override an unsubscribe, bounce, suspicious-email restriction, or another suppression reason.
  • Deadweight is not a deliverability, tax, legal, or accounting adviser.

Your responsibilities

You confirm that you are authorized to connect the workspace, instruct the processing, approve suppression, and provide any subscriber data involved. You are responsible for your own retention, consent, direct-marketing, and customer-notice obligations, for reviewing the Klaviyo segment before approval, and for choosing any final Klaviyo plan change.

You must not use the service to access another party's account, evade platform controls, process unlawful data, or interfere with service security.

Fees and capabilities

Current public offers are a free audit, a $149 one-time verified cleanup, and Monitor at $29 per month. The checkout screen and order confirmation control the final price, currency, taxes, billing period, and included capability. A one-time cleanup is consumed only when the cleanup is approved and queued. Monitor does not include automatic or unapproved suppression.

If checkout is unavailable or an offer is not correctly configured, Deadweight will refuse the transaction rather than grant an unverified capability.

Third-party services

Klaviyo, the payment provider, email provider, hosting provider, and network provider operate under their own terms. Deadweight is not responsible for their independent outages, API changes, account restrictions, pricing, or billing decisions, but will preserve local job evidence and fail safely where practicable.

Availability and changes

The service is provided with reasonable care, but it may be interrupted for maintenance, provider outages, security work, or API changes. Material changes to paid capability will be communicated through the service or the account contact. We may suspend access needed to prevent abuse or protect customer data.

Confidentiality and data

Each party will protect the other's non-public information using reasonable measures. Processing of Klaviyo subscriber data is governed by the DPA. Privacy practices for Deadweight account data are described in the Privacy Notice.

Warranty and liability

To the maximum extent permitted by applicable law, the service is provided without a promise that a particular number of candidates will be found or that an invoice will decrease. Neither party excludes liability that cannot lawfully be excluded. Any order-specific liability cap, governing law, venue, refund rule, and service commitment will be stated in the paid order terms. If those terms conflict with this page, the signed or accepted order terms control.

Termination

You may stop using the service, revoke OAuth, and delete a workspace. Termination does not undo a Klaviyo action already submitted and does not remove payment or accounting records that must be retained. Provisions that by nature should survive, including confidentiality, payment, data protection, and liability terms, continue as required.
